Orphans are brothers, and wedding idolatresses is forbidden till they believe

Surah ‘Al-Baqarah (The Cow) – Chapter – 2)

BisMIllaahir-Rahmaanir-Rahiim
In the name of God, the Beneficent, the Merciful

And if ye mingle your affairs with theirs, then (they are) your brothers. And Allah knoweth him who spoileth from him who improveth. And had Allah willed He would have overburdened you. Surely Allah is Mighty, Wise.         
Wa  ‘in-  tukhaalituu-hum  fa- ‘ikhwaanukum.  WAl-laahu  ya’- lamul-mufsida  mi- nal- muslih.  Wa  law shaaa- ‘Allaahu  la- ‘a’ –natakum.  ‘InnAllaaha  ‘Aziizun  Hakiim.

Lesson
 
We have recited the question of the Companions (Sahaabah) (may Allah be pleased with them) concerning orphans. In reply Allah Almighty commanded with complete detail that improving the lot of orphans is best in reward and remuneration. Their position is like your brothers. Then formality with them is of what sort? The purpose is to improve the lot and correction of the orphans’ wealth and property, so one should do as he seems better. If any individual thinks that there is some more advantage in separating their accounts, then he should do so. But if he considers that the orphan will remain in gain due to mutual business, then nothing is wrong with it also. After all, they are your religious brothers.

The orphans are considered as extremely despised and humiliated in the old cultures and besides this among several existing nations, but Islam has explained by saying them ‘ikh-waanukum (your brothers) that there is no difference between you and them being a mankind. They should be dear to you as your own brothers are dear to you. They have the right to improve themselves. None should stand in their way. Moreover, they should be helped to achieve their goals as one brother helps the other. So you should keep in view their correction and betterment in each condition, and for it; you can adopt any method which you like. God Almighty knows the secrets of everybody’s heart and understands that who spoils and who improves.

After it, God Almighty commanded also that if Allah Almighty wished, a strict order might be given too, which you had to do, because He is Mighty, Wise. But He did not do so because He understands the advisability of every Command. He doesn’t order which may be difficult and heavy.


  
221a.  Wed not idolatresses till they believe.           
221a.  Wa  laa  tankihul-mushri-kaati  hattaa  yu’-minn.

Lesson

‘Al-mushri-kaati – (the idolatresses), this word has been derived from shirk which means ascribing plurality to Allah Almighty, that is to say; the woman who includes any other person or thing in the virtues of God Almighty. This word has been used in its vast and common meanings. Every infidel woman is included in this command. It is not necessary that she should be only idolatress. To wed any non-Muslim woman is unlawful according to the theologies of spiritual guides (Imam) Maalik and Shaaf-‘aii, but in accordance with the scholars of Hanfii theology it is unlawful to wed each non-Muslim woman as a common rule, but it is lawful to marry any woman from the people of the Scripture i.e. the Jews and the Christians. Its permission exists formally in the Divine law of the religion.

God Almighty has forbidden the Muslims to marry the idolatresses in this verse. Further explanation of this Command is as under:-

·         To wed any disciple of a worshiper of fire (woman of the sect of Magi), Sikh and Hindu women is not lawful.

·         It is lawful to marry any woman from the Jews or the Christians (because they belong to the heavenly religions) but not better. Hadrat Umar (may Allah be pleased upon him) has disliked it. Instigation and stress exists also in the Sayings of the Messenger of God Almighty (grace, glory, blessings and peace be upon Him) to marry any religious woman only.

·         The woman who seems as she belongs to the heavenly religion from her style, but if it is known by means of investigation afterwards that her Belief is not as of the people of the Scripture, then it is not just to wed her too.

In short, it is not lawful to marry any that woman who is disbeliever. Islam has not banned in connection with the marriage with any race, color or caste etc, but restricted for the Believer and correct Belief only. The basic reason of it is that the relationship of husband and wife is perfect love and friendship. Deep relation is necessary among both of them. It is compulsory for the accomplishment of husband and wife successfully for life that the wife should not be denier of the universal laws of her husband namely Oneness of God and Belief in the last Messenger (grace, glory, blessings and peace be upon Him). If this relation doesn’t exist between them then it is quite impossible to pass their lives successfully in any aspect, and the bigger badness than it is that it affects the education, religion and future of their children. Their father pulls them toward himself and the mother toward herself. The result is clear.

The husband will decide the matters of his domestic life in the light of this faith. The wife will think according to her own faith. The quarrel and vigorous contradiction will remain always between them. It will affect badly their children and their future will be destroyed. So, it is commanded that you should not wed any idolatresses till she believes to escape yourself from the results of too much destruction. This restriction exists in the Jews and the Christians religiously also. However, it is another thing; if they don’t act upon it.
